These Terms of Service (“Terms”) govern your purchase and use of Realty AI’s chatbot services, operated by 4 Sigma Solutions Inc. (“we,” “our,” or “us”). By purchasing our services, you agree to these Terms. If you do not agree, you may not access or use our services.

1. Services Provided

Realty AI provides realtors access to an AI-powered chatbot to engage website visitors, manage conversations, and book appointments. These may include limitations on the number of interactions, features available, and support levels. By selecting a particular plan, you agree to abide by the specific terms and limitations associated with that plan. If you exceed the usage or feature limits of your plan, Realty AI reserves the right to charge additional fees, downgrade your plan, or limit access to certain features.

2. Payment and Access

a. Limited Usage Terms:
The chatbot license permits up a plan specified usage limit, unless otherwise agreed in writing. Realty AI reserves the right to limit excessive usage that impacts system performance for other users.

b. License Termination:
In the event of abuse, misuse, or violation of these Terms, we reserve the right to revoke access to the chatbot without a refund. Furthermore, we may suspend access pending investigation of any misuse or violation.

3. Changes to the Service

a. Substantial Modifications or Upgrades:
Realty AI reserves the right to update, modify, or discontinue features of the chatbot at any time. If such changes substantially alter the chatbot’s functionality or result in a significantly upgraded product, we may, at our discretion, choose to stop providing the original service and replace it with the new and improved product. In this case:

We will notify you at least [30 days] in advance of the transition to the upgraded product.
You will have the option to transition to the new product or discontinue use.

b. Discontinuation of Support:
In the event Realty AI ceases operations or transitions to a different business focus, there is no obligation to maintain, update, or continue supporting the chatbot. However, we will notify you as soon as possible, and a notice period will be provided, at our discretion, to allow you to transition or export data.

4. Termination for Convenience

Either party may terminate this agreement for any reason by providing at least one (1) month’s written notice to the other party. Upon termination, all rights to use the chatbot will end, and no further payments will be due. However, payments already made are non-refundable.

5. Acquisitions or Business Transfers

If Realty AI or 4 Sigma Solutions Inc. is acquired, sold, or undergoes a merger, the acquiring entity may continue, modify, or discontinue the Service. By agreeing to these Terms, you waive any claims, liabilities, or recourse against Realty AI or the acquiring entity for changes or termination of service. You will be notified promptly of such events where legally required.

6. No Warranties

The Service is provided on an “as-is” and “as-available” basis without warranties of any kind, either express or implied. Realty AI does not guarantee uninterrupted or error-free operation of the chatbot. Furthermore, Realty AI is not responsible for third-party integrations or issues that may arise outside of our direct control.

7. Limitation of Liability

To the fullest extent permitted by law, Realty AI and 4 Sigma Solutions Inc. shall not be liable for:

Any loss of data, revenue, or profits arising from the use or inability to use the Service.
Service interruptions caused by technical issues, maintenance, or modifications.
Any direct, indirect, incidental, or consequential damages related to the chatbot or these Terms.

In no event shall our liability exceed the total amount paid by you for the Service.

8. Privacy Policy

By using Realty AI’s services, you acknowledge that your information will be handled according to our Privacy Policy, which can be reviewed on our website. You are responsible for ensuring that your data complies with applicable data protection laws.

9. Governing Law

These Terms are governed by the laws of Canada. Any disputes arising under these Terms shall be resolved exclusively in the courts located in Alberta We encourage dispute resolution via mediation before proceeding to litigation.

10. Indemnification

You agree to indemnify and hold harmless Realty AI and 4 Sigma Solutions Inc. from any claims, damages, or losses arising from your misuse of the Service, violation of these Terms, or infringement of any third-party rights.

11. Third-Party Links and Services

The Service may contain links or access to third-party websites or services not owned or controlled by Realty AI. We are not responsible for the content or availability of these external sites or services. Your use of third-party services is at your own risk.

12. Amendments to Terms

We may update these Terms at our discretion. Changes will be posted on our website and will take effect immediately for new users. For existing users, changes will apply 30 days after posting unless otherwise stated.
